The agreement

These terms are an agreement between you and Specter Industries LLC, the company that owns and runs Specter Industries at specterindustriesinc.com. By using the site you accept them. If you do not accept them, do not use the site.

They apply to everyone who uses the site, wherever they are in the world. Nothing in them takes away a right that the law of the country where you live gives you and that cannot be given up by agreement.

You must be at least 16 years old to use the contact form. The rest of the site can be read by anyone.

This site and the products

This site presents the company, its products and the person behind it. It sells nothing and creates no account. The products it describes, such as Athenos, Clardesk and Unavist, are separate services on their own domains. Each has its own terms and privacy policy, and those, not these terms, govern your use of it.

Information on this site about a product describes it in general terms. It is not a warranty, a specification or an offer, and a product's own terms prevail over anything said about it here. Products marked as in build or under development may change or may never ship; a slot on this site is a statement of intent, not a promise.

Acceptable use

You may read the site, link to it and share its pages. You may not:

• Attack it: probe, scan or test it for vulnerabilities except as invited by its security.txt, interfere with its operation, or try to get past any rate limit or other protection.
• Flood it: send automated requests at a rate that a person could not, or scrape it in a way that burdens the service.
• Misuse the contact form: send spam, unlawful, threatening or abusive content, or impersonate someone else.
• Copy the site, its design or its content to pass off as your own.
• Use the site in a way that breaks any law that applies to you.

The company may block connections that break these rules without notice, and may report unlawful conduct to the authorities.

The contact form

The form is the only channel to the company. Sending a message does not create a contract, a client relationship or an obligation to reply, although every message is read. Do not send confidential information, passwords or anything you would not want held for the period described in the privacy policy. By sending a message you confirm that it is yours to send and that the details you give are accurate.

What belongs to the company

The site and everything on it, including the text, the design, the type system, the generated artwork, the code that runs it, the Specter Industries name, the S mark, and the product names, belong to Specter Industries LLC or are used with permission, and are protected by copyright, trademark and other laws. Product names built with a partner are used with that partner's agreement.

You may view the site and keep a copy of a page for your own reference. You may quote short passages with attribution and a link. You may not otherwise reproduce, modify, distribute or use the content, marks or design without written permission, which you can ask for through the contact form. Linking to any page is welcome; framing the site inside another site is not.

Links to other sites

Links from this site lead to the company's products and, occasionally, to third parties. The company is responsible for the pages on this domain only. Once you leave it, the terms and privacy practices of the site you arrive at apply.

No warranties

The site is provided as it is and as it is available. To the fullest extent the law allows, the company gives no warranty about it, express or implied, including that it will be uninterrupted, error-free, secure, or that its content is complete or current. Content is general information and is not professional advice of any kind.

Limits on liability

You pay nothing to use this site, and its limits on liability reflect that. To the fullest extent the law allows, Specter Industries LLC, its owner and anyone working for it are not liable to you for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, data, goodwill or opportunity, arising from your use of or inability to use the site, however caused. To the same extent, total liability for all claims connected to the site is limited to one hundred United States dollars.

Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for anything else your local law does not allow to be excluded. If you are a consumer, you keep every protection that consumer law gives you.

Availability and changes

The company may change, suspend or close the site or any part of it at any time without notice. It may change these terms; when it does, the date at the top changes and the new terms apply from the moment they are published. Continuing to use the site after a change means you accept it.

Governing law and disputes

These terms are governed by the laws of the United States and of the state in which Specter Industries LLC is organized, without regard to conflict-of-law rules. Any dispute that cannot be settled between us is to be brought in the state and federal courts located in that state, and you and the company accept that those courts have jurisdiction. If the law of the country where you live gives you the right to bring a claim, or to be sued, in your own courts as a consumer, that right is not affected.

Before either of us goes to court, we agree to try to resolve the matter directly. Write through the contact form and allow thirty days for an answer.

General

These terms, together with the privacy policy and the cookie policy, are the whole agreement about your use of the site. If a court finds any part of them unenforceable, the rest stays in force and the part is read as narrowly as needed to make it enforceable. A failure to enforce a term is not a waiver of it. You may not transfer your rights under these terms to anyone else; the company may transfer its rights to a successor that takes over the site.
